What is AML/CTF Tranche 2 and does it apply to my business?

Tranche 2 represents the most significant expansion of Australia's anti-money laundering and counter-terrorism financing regime in nearly two decades. From 1 July 2026, thousands of Australian professional services firms including real estate agents, accountants, lawyers, conveyancers, and dealers in precious metals and stones will be captured under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 for the first time. AUSTRAC enrolment opens 31 March 2026. If your business provides a designated service under the expanded regime, enrolment is mandatory and not optional. The penalties for non-compliance are significant and include civil and criminal consequences. If you are unsure whether you are captured, the answer is almost certainly yes, and you should find out immediately.

What happens if I miss the 31 March 2026 AUSTRAC enrolment deadline or the 1 July 2026 compliance date?

Missing these deadlines is not a procedural oversight. It is a regulatory breach. AUSTRAC has broad enforcement powers, including the ability to issue infringement notices, impose civil penalties, and refer matters for criminal prosecution. Beyond the direct legal consequences, a failure to enrol or comply creates lasting reputational damage and can affect your professional licences and client relationships. The time to act is now and not when you receive a notice.

What does AML/CTF compliance actually require my business to do?

At a minimum, Tranche 2 obligations will require your business to enrol with AUSTRAC, designate a compliance officer, develop and implement an AML/CTF Program covering both Part A and Part B, conduct customer due diligence including enhanced due diligence for higher risk customers, train staff on their obligations, and submit annual compliance reports. The depth and complexity of each requirement will depend on your business model, the designated services you provide, and your risk profile. Getting this right from the outset is materially easier and cheaper than remediation after the fact.
